The Oregon Municipal Court has a Criminal Offense Diversion Program for first-time offenders who are charged with a non-violent misdemeanor criminal offense. Successful completion of this program can result in criminal charges being dismissed and records pertaining to the case being expunged or sealed. Certain offenses such as drug charges, domestic violence, or driving while impaired render the defendant ineligible for this program. 

A complete local, state, and federal criminal history check is conducted on each person before they are accepted into the program. This includes juvenile court records.

Program Requirements

• Must remain law abiding
• Complete an education class
• Perform community service work
• Pay a supervision fee for program
• Make restitution, if applicable
• Comply with any other Court orders instituted on a case-by-case basis

Eligibility Factors

1. Defendant must have been cooperative with police officer(s)
2. Non-violent offense
3. Evidence of remorse
4. No prior criminal record
5. No pending criminal cases

Ineligibility Factors

1. Past D.U.I. conviction
2. False statements or discovered lying to a law enforcement officer
3. Violence or threats of violence connected to this offense
4. Other criminal offenses charged with this offense
5. Warrant(s) for the defendant’s arrest at the time of their appearance before this Court
